Abstract (English)

In this thesis the topic "The § 57a-inspection in the KFG", including the relevant topics out of the law of authorised experts, is dealt with. Hence, in case of the latter, reference is made, particularly to the expert in charge, because this is the one who has to carry out the periodic checks on the motor vehicle in the workshop. For a better understanding of the responsibilities and tasks of the expert who is in charge, the thesis explains also the responsibilities of the expert who will be ordered by judge, the expert in the administrative procedure, and finally the private expert as well. However, in the third chapter the § 57a-inspection is covered specifically. This inspection also represents the main topic of the thesis. In particular, the test procedure from a legal perspective as well as the chronological sequence, which simply means when and how often an inspection of a vehicle must occur, is described in this chapter in more detail. In addition, a distinction is made for the special inspection according to the § 56 KFG, which is in contrast to the § 57a-inspection, because it is not a periodically one. Furthermore, by going into the PBStV, the subject matter surrounding the § 57a-inspection is further deepened. It shows the items to be checked at the vehicle. This simply refers to the aspects which the car technician, as an expert in charge, has to pay particular attention in the assessment in the workshop. Finally, the appraisal resulting from § 57a-inspection will be discussed in form of an expert inspection report. In this report, the results of the assessment are recorded so that it can subsequently be ascertained whether or not a vehicle has been approved for traffic on public roads according to the § 57a-inspection.
